Fiqh of Transactions Part 04
Contemporary Scholars Proficient and Expert in Fiqh of Transactions:
Sheikh Muhammad Taqi Usmani
Who doesn't know him?
He is a central figure in merging tradition with modernity.
He is the primary reference for offering new solutions to contemporary issues without compromising the principles of Islamic Sharia.
Every student of Fiqh, especially in Fiqh of Transactions, should benefit from him to gain expertise in both Fiqh of Worship and Fiqh of Transactions, understanding that its compilation and arrangement are based on divine revelation and its golden principles.
This Sheikh has made significant contributions to Fiqh research and Sulook in the form of following the Sunnah, completing the Sulook path of Maulana Ashraf Ali Thanvi (may Allah have mercy on him). He is a devout and pious individual, adorned with noble character traits. Documenting his scholarly journey would require a voluminous book.
"Yadain" is an autobiography (in Urdu) that encompasses many aspects of his life.
To highlight his scholarly stature, I would like to present two valuable documents to my fellow students:
1. The scholarly session held by the Qatari Ministry of Awqaf to celebrate the release of Sheikh's book "Tawtheeq al-Duyoon."
This entire session is in Arabic. During this session, as a student of Sharia and Islamic Fiqh, I felt immense gratitude for what I understood from the Arabic language and Fiqh points, all thanks and prayers to my teachers and scholars who worked hard in my training, and as a result of discussions and intellectual exchanges with fellow students and dear learners.
In this book, the Sheikh's Fiqh expertise, especially in our contemporary times, can be understood through his preference for the Maliki school of thought over the Hanafi school in a modern issue related to mortgaging, a skill claimed by many but often only as a mere assertion.
Overview of Sheikh's Book "Tawtheeq al-Duyoon"
- Provides guidance on financial transactions and debt documentation based on Islamic principles.
- Emphasizes the importance of documenting financial transactions and applying them according to Sharia requirements, explaining the reasons for this necessity.
- Includes details on structuring contracts, the role of witnesses, and the ethical responsibilities of the involved parties.
- Highlights the importance of transparency and trust by referencing the Quran and Hadith.
