In Fiqh of Transactions, these terms are more frequently mentioned compared to Fiqh of Worship and Ibadat.

One of the foundations of this term is the statement mentioned in the books of Fiqh by Imam Al-A'zam Abu Hanifa (may Allah have mercy on him) where he said: "We prepare for tribulations before they occur, so when they happen, we know how to enter and exit them." He said this in front of his teacher Qatada Rahimahullah (may Allah have mercy on him) when seeking his opinion on a hypothetical issue concerning a woman whose husband had gone missing. Qatada Rahimahullah (may Allah have mercy on him) expressed surprise because the situation had not yet occurred... May Allah reward them.

In the modern Fiqh discussions of the later scholars on contemporary Fiqh issues, "Fiqh al-Nawazil" (emergent issues) often derives from this famous statement of Imam Abu Hanifa (may Allah have mercy on him) and from what the earlier scholars called "Nawazil Fiqhiyah."

It is likely that the book "Nawazil Fiqhiyah Mu'asirah" by Maulana Khalid Saifullah (may Allah bless him) is named after this concept.
